Kansas NOW is proud to be leading in the effort to amend the constitution of the state of Kansas to add a provision that addresses complete equality of the sexes. The amendment states, “Equality of rights under the law shall not be denied or abridged by the state or any of its political or taxing subdivisions on account of sex”.
Currently, the Kansas Constitution addresses the rights of women only to grant them the right to vote, own property and in the possession of their children. This leaves all other rights and protections under various statues and laws, which could potentially be altered with the momentum of each passing legislative body.
Kansas NOW believes that an Equal Rights Amendment to the Kansas Constitution will serve as a collective constitutional commitment toward the equality for women in the state of Kansas. If approved by the voters of Kansas, it will provide the permanency that current gender discrimination laws and statues do not have. If the judicial interpretation patterns of the 22 other states that currently have ERA’s in their constitutions hold true, it will encourage a more rigorous judicial scrutiny standard to be applied in cases of sex discrimination, bringing these cases under the same level of scrutiny as cases of race discrimination.
